TERMS OF USE

Access to and use of NeoLife websites as well as online products and services available are subject to the following terms of use.

  1. Introduction
    1. These Websites can be accessed at www.NeoLife.com & www.shopneolife.com.
    2. These Website (“Terms of Use”) govern the ordering, sale and delivery of Goods, and the use of these Websites.
    3. These Terms of Use are binding and enforceable against every person that accesses or uses these Websites.
    4. These Websites enables you to shop online for an extensive range of Goods including Health care, Nutrition, Home care, Personal care products, and Business sales aids.
  2. Important Notice
    1. These Terms of Use apply to users who are consumers for purposes of the Consumer Protection Act, 68 of 2008 the (“CPA”).
    2. If there is any provision in these Terms of Use that you do not understand, it is your responsibility to ask NeoLife International to explain it to you before you accept the Terms of Use or continue using these Websites.
    3. Nothing in these Terms of Use is intended to unlawfully restrict, limit, or avoid any right or obligation created for either you or NeoLife International in terms of the CPA.
    4. NeoLife International permits the use of these Websites subject to the Terms of Use. By using these Websites in any way, you shall be deemed to have accepted all the Terms of Use unconditionally. You must not use these Websites if you do not agree to the Terms of Use.
  3. Detailed description of Goods and/or services. NeoLife International is a company in the Direct Selling Industry that sells Nutrition, Health care, Home care and Personal care products and Business sales aids.
  4. Registration and use of these Websites
    1. Only registered users may order Goods on these Websites.
    2. To register as a user, you must provide a unique username and password, and provide certain information and personal details to NeoLife International. You will need to use your unique username and password to access these Websites in order to purchase Goods.
    3. You agree and warrant that your username and password shall:
      • be used for personal use only; and
      • not be disclosed by you to any third party.
    4. For security purposes you agree to enter the correct username and password whenever ordering Goods, failing which you will be denied access.
    5. You agree that, once the correct username and password relating to your account have been entered, irrespective of whether the use of the username and password is unauthorised or fraudulent, you will be liable for payment of such order.
    6. You agree to notify NeoLife International immediately upon becoming aware of or reasonably suspecting any unauthorised access to or use of your username and password, and to take steps to mitigate any resultant loss or harm.
    7. By using these Websites, you warrant that you are 18 (eighteen) years of age or older and of full legal capacity. If you are under the age of 18 (eighteen) or if you are not legally permitted to enter into a binding agreement, then you may use these Websites only with the involvement and supervision of your parent or legal guardian. If your parent or legal guardian supervises you and gives his/her consent, then such person agrees to be bound to these Terms of Use, and to be liable and responsible for you and all your obligations under these Terms of Use.
    8. You agree that you will not in any way use any device, software, or other instrument to interfere or attempt to interfere with the proper working of these Websites. In addition, you agree that you will not in any way use any robot, spider, other automatic device, or manual process to monitor, copy, distribute, or modify these Websites or the information contained therein, without the prior written consent from an authorised NeoLife International representative (such consent is deemed given for standard search engine technology employed by Internet search websites to direct Internet users to these Websites).
    9. You may not use these Websites to distribute material, which is defamatory, offensive, contains or amounts to hate speech, or is otherwise unlawful.
    10. You may not in any way display, publish, copy, print, post, or otherwise use these Websites and/or the information contained therein without the express prior written consent of an authorised NeoLife International representative.
  5. Conclusion of sales and availability of stock
    1. Distributors, Members and Retail Customers may place orders for Goods and NeoLife accepts an order depending on the availability of Goods and receipt of payment or payment authorisation. Subject to availability and receipt of payment, requests will be processed within one day and delivery confirmed by way of SMS or email.
    2. Regardless of any communication from NeoLife International stating that your order or payment has been confirmed, NeoLife International may indicate the rejection of your order due to non-availability of Goods by cancelling it as soon as possible, thereafter, refunding you for any amount already paid, or asking you to choose another available product.
    3. Prior to delivery or your collection of the Goods, you may cancel an order at any time, provided you do so before receiving a dispatch or delivery notice. After delivery or your collection of the Goods, you may return the Goods only in accordance with the Returns Policy and will be liable for the returned deliver fee.
    4. Placing Goods in a Wishlist or shopping basket without completing the purchase cycle does not constitute an order for such Goods, and as such, Goods may be removed from the shopping basket if stock is no longer available.
  6. Customer Privacy policy. NeoLife International shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA).   7. Export restriction (Optional).The offering on these Websites is available to all Distributors, Members and Retail Customers.
  8. Payment
    1. We are committed to providing secure online payment facilities. All transactions are encrypted using appropriate encryption technology.
    2. Payment may be made via Visa, MasterCard, Maestro, debit card and bank transfer into the NeoLife International bank account. You warrant that you are fully authorised to use the credit/debit card supplied for this purpose.
    3. Note we do not accept Diners Club and American Express card services.
  9. Delivery of Goods
    1. NeoLife International offers 3 (three) methods of delivery of Goods to you. You may elect delivery via:
      • Home delivery: Free delivery will apply for all orders that are 100PV and more, and for all orders less than 100PV a delivery charge of R100 will be automatically added to your order.
      • All collections at NeoLife distribution centres are free and does not have a collection charge.
      • Collections at collection points will incur a collection fee of R40 for orders less than 50PV and all orders that are 50PV or more, free collection will apply.
    2. NeoLife International will deliver the Goods to you within 2-4 days, but no later than 7 (seven) days of receipt of your payment. We will notify you if we are unable to deliver the Goods during the Delivery Period. Deliveries in outlying areas could take up to 7 working days for delivery.
    3. NeoLife will not deliver outside the borders of the country where Goods were purchased.
    4. NeoLife International’s obligation to deliver a product to you is fulfilled when we deliver the product to the physical address/collection point nominated by you for delivery of the order. Distributors should sign the waybill and indicate if any items were missing or damaged to enable NeoLife to claim the loss from the courier company.
  10. Return and Refunds policy. The provision of Goods and services by NeoLife International is subject to availability. In cases of unavailability, NeoLife International will refund the client in full within 3 days. Cancellation of orders by the client before delivery will not attract an administration fee. A Distributor can return the product within 90 days from the order date, and she/he will pay 10% BV if he/she is returning the cases and 15% BV if he/she is returning the singles. NeoLife has a returns Policy. Please refer to the Company Policies and Procedures.
  11. Errors. Should there be errors of any nature on the processing we shall refund you for any amount you have already paid, or otherwise as set out in the Returns or Cancellation Policy.
  12. Card acquiring and security. Card transactions will be acquired for NeoLife International Pty Limited via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no card details are stored on the website. Users may go to www.PayGate.co.za to view their security certificate and security policy.
  13. Customer details separate from card details. Customer details will be stored by NeoLife International separately from card details which are entered by the client on PayGate’s secure site. For more details on PayGate refer to www.PayGate.co.za.
  14. Merchant Outlet country and transaction currency. The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).
  15. Responsibility. NeoLife International takes responsibility for all aspects relating to the transaction including sale of Goods and services sold on these Websites, customer service and support, dispute resolution, and delivery of Goods.
  16. Country of domicile. These Websites are governed by the laws of South Africa and NeoLife International chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, Private bag x 400, Modderfontein, 1645
  17. Variation. NeoLife International may, in its sole discretion, change this agreement or any part thereof at any time without notice.
  18. Company information. These Websites are run by NeoLife International Pty Limited, a private company based in South Africa trading as NeoLife International and with registration number 1971/005077/07 and Pieter De Bruin, Simon Whetzel and Marco Taylor are the Directors.
